Guidant Lawyers, Guidant Lawsuits

A Guidant lawsuit may be warranted in order for a person to receive the proper compensation related to a death or injury from a defective Guidant product. A Guidant lawsuit, if properly filed and executed, can lead to a settlement that can cover the medical and other costs related to the injury or death.

Medtronic Sprint Fidelis Leads Recalled

Guidant is a large manufacturer of medical products, with billions of dollars in annual sales. Guidant has a responsibility to insure that patients are protected from negligent acts that could lead to a serious injury of a patient, or even death.

It is possible that Guidant was aware of the defects in their products before the safety announcements and the FDA Guidant recall on June 17, 2005. In March 2005, a 21-year-old college student, who had heart disease and had been implanted with a Guidant defibrillator, died due to a faulty Guidant product. After the student's tragic death, Guidant informed doctors that they were aware of other similar failures of the product. If the company was indeed aware of the defective products, which have lead to at least two deaths reported by the company, then the company is negligent for not reporting and fixing the product earlier.

Wrongful Death Guidant Lawsuit

A wrongful death lawsuit is filed when there is a death that occurs due to the negligence on the part of another person or entity. In the case of Guidant, if Guidant did not take the proper steps to insure quality of the defibrillators and the defibrillator failure leads to the death of a patient, then Guidant is responsible for a wrongful death. Guidant also has a responsibility to its client physicians and their patients to correct any defects in these products as soon as they become aware of the defects. If Guidant waited to take corrective action, and patient deaths occurred from this hesitation, then Guidant is responsible for wrongful death.

Guidant wrongful death lawsuits can compensate the victim's family for the loss of a lifetime of earnings the victim would have had, if he or she had lived. Guidant wrongful death lawsuit settlements can also compensate the victim's family for health care bills, medications, funeral arrangements, etc. And depending on the level of negligence, punitive damages can be awarded for a company's actions. In cases where there is no fatality, Guidant lawsuits can compensate victims for the serious injuries that caused the loss in the quality of life or the loss of ability to maintain a specific profession.
